The Demise of the 28-Point Peace Proposal for Ukraine: How Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the crisis sparked by the introduction of a new comprehensive peace framework for resolving the conflict appeared – momentarily – to have been contained. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: a renewed assault of rocket attacks on Kyiv.

The Rhythm of Negotiation and Warfare

The chain of contrasting events captured the grim essence of the outgoing year. By day, negotiation efforts are conducted: hopeful statements are issued from multiple capitals. Considerable effort is expended on restraining particular approaches. By night, Moscow brutally reminds the world that, for them, conflict continues to be the key method for achieving "resolution".

Nighttime Reality

As the offensive developed into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was exposed. Ukraine is equipped to monitor missile launches from enemy soil, a capability enabled by timely intelligence. From vantage locations, defense planes that had been dispatched to engage hostile aerial threats flew past – modern combat jets delivered to Ukraine by Western partners.

Shortly after, Kyiv's anti-aircraft weapons activated: several firings deployed against a incoming threat. This was a sophisticated defense system at work, most likely delivered by partner states. Every deployment creates sudden vibrations, shaking the windows. The instant of fear quickly gives way to resigned acknowledgment: maybe the incoming missile won't hit its mark this time, preventing destruction from ruin and further power outages.

Continuous Dangers

Following this, a heavy machine gun opened up on a aerial vehicle somewhere nearby, part of a defensive team – most likely imported technology. Unfortunately, the shots failed to hit the hostile drone – it pressed on overhead toward its objective.

Periodically, this persisted until dawn. Kyiv greeted the daybreak reports: multiple fatalities, destruction and utility failures in many homes as a result of the nocturnal offensive. As typically, everyone still went about their day – living the war. But those full day demonstrated Ukraine's critical military reliance on Western support – a reliance that regional partners are demonstrably unable to substitute in the short term.

Failed Diplomacy

The detailed framework from Washington generated strong feelings, debate and profound anxiety – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and multilateral gatherings.

Every new proposal from US leadership follows the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They stabilise the situation but never actually win the battle. This trend will, certainly, continue.

Tactical Assessments

It is easy to blame particular leaders of persistently promoting Russian terms. But that does not seem to be the entire situation. American leadership operates on a principle understood by seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The US administration believes that it is unfeasible to pressure the Kremlin to relinquish the land that it presently holds in Ukraine's occupied territories.

The issue is that while accepting these circumstances, Washington does nothing to deter Moscow, through words or deeds, from believing that the status quo will not evolve additionally in its advantage in the coming year.

Opposing Positions

Therefore, Moscow is convinced that duration works to their advantage – that Ukraine and its supporters are approaching exhaustion. Their motivation to accept conditions that does not give them the greatest potential benefit is virtually nonexistent. There may be many attempts to stop fighting, but they will carry on as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Kyiv believes that Ukraine can still hold out, slowly losing lives and land but avoiding a complete military breakdown until conditions improve in its favour.

Present Conditions

Factually, there are no actual prerequisites for a ceasefire. Now, personal considerations are becoming relevant: personal goals to broker a ceasefire and obtain worldwide acknowledgment, and the government's dual difficulties – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the flag against any plan Kyiv finds unacceptable, so that their focus does not switch to homefront challenges. And although their objective will now be much harder after recent developments, it remains highly unlikely that this will modify their basic position.

These opposing factors are guiding negotiations.

Summary and Prospects

It took a mere seven days to kill the 28 points of the most recent proposal. Aggressive and erratic handling of the matter by American leadership, pushback by Ukraine and the remaining European nations, along with pacifying measures of diplomats, and finally, recent disclosures, all achieved their purpose.

While new plans based on previous concepts are forthcoming, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are based on Russian demands and demonstrate certain reluctance to change the course of events, if they remain united and enhance their military capacity at a much faster pace. If they do, neither external pressure nor military threats will be able to overcome them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the foreseeable future, mainly require ongoing international assistance.
